" IV. Conclusion 

As set forth above, the Court finds that Adobe has not demonstrated a likelihood
of success on the merits of its
trademark or copyright claims. The Court finds that Adobe has not demonstrated
that it will suffer irreparable
injury in the absence of preliminary injunctive relief, particularly in light of
Adobe's own admissions that it has
known about SoftMan's activities since 1997. The Court denies Adobe's
application for a preliminary injunction.
The Court hereby ORDERS that the preliminary injunction entered by this Court on
September 10, 2001 be
VACATED. "
