Technically, I think that's all the they're obliged to ensure. The CD
standard isn't something like the kitemark or the CE mark that has legal
force.

Yes. Especially things like the PS2 which aren't patchable. We should make
as much (legitimate) noise about this as possible, until they're forced to
do something about it. This "something" will probably take the form of a
disclaimer, but even that will give useful publicity about the existence
of broken CDs.
