OK, this is a contentious position and I expect to hear the
counter-case, but it seemed right to present it:

When I'm dancing to a band playing a cover of some copyright work I am
performing (in public) a derivative work of the copyright work.  I have
not consulted the copyright-holder prior to doing so, least of all
obtained their permission.  Any performing `rights' dues the band paid
for covering someone else's work covered *the band*'s performance of the
music: it did not cover the audience's enjoyment of it.

That means I'm performing a derivative of a copyright work in public
without the consent of the `rights'-holder.  All dancers are criminals.

In case anyone misses my point here: a law (allegedly) intended to
promote artistic work criminalises an entire category of artistic work.
I'm sure the hip-hop community and I can find a bond of solidarity here.
